Judge revokes Dahl’s bond following arrest By David Montgomery Capital Journal staff Published/Last Modified on Tuesday, Nov 17, 2009 - 02:50:27 am CST FORT PIERRE — Fort Pierre resident Flint Dahl, facing criminal charges in three different cases that include the alleged abuse of a horse, is in prison for violating the terms of his bond after an arrest last week. Dahl, 22, is facing new charges of ingesting marijuana, first-offense commercial driving under the influence, driving without a commercial driver’s license and violating his bond by drinking and smoking marijuana. Because Dahl allegedly violated the conditions of his bond, Stanley County Magistrate Judge Mark Smith revoked Dahl’s bond Monday. Dahl is currently in jail awaiting a Nov. 23 court appearance. The $5,000 cash bond paid by Dahl’s father Dave Dahl will be returned. Advertisement The four new charges will join eight other criminal violations Dahl is accused of committing in the past five months. In a July 5 incident involving a rodeo horse recovered injured outside its pen, Dahl is facing a felony grand theft charge and a misdemeanor charge of inhumane treatment of an animal. In an Aug. 28 incident, Dahl is charged with threatening law enforcement, obstruction and disorderly conduct in an altercation with a Stanley County Sheriff’s Deputy. All three charges are misdemeanors. In a Sept. 5 incident where a pickup driven by Dahl struck a utility pole, Dahl is charged with hit-and-run property damage, reckless driving and failure to report an accident. At his Nov. 23 court date, Judge Smith will reconsider Dahl’s bond. Dahl also will have preliminary hearings for the horse-theft case and the disorderly conduct case, an arraignment for the hit-and-run case and a status hearing for the new case. The new charges come from an incident on Nov. 13 when a Stanley County Sheriff’s Deputy pulled Dahl over while he was driving a semi-tractor trailer. A breathalyzer test reported a blood alcohol content of .077 percent, under South Dakota’s legal limit of .08 percent. However, a condition of Dahl’s release on bond for the traffic accident case was a ban on consuming alcohol. Additional charges may be forthcoming from a Nov. 11 highway patrol traffic stop west of Fort Pierre in which Dahl was cited for speeding and not wearing a seat belt. In that incident, highway patrol officers reported smelling marijuana. Dahl claimed he had been at a party where marijuana was being smoked. Highway patrol officers informed Stanley County Sheriff’s Deputies of this incident. When Dahl was arrested Nov. 13, deputies collected a urine sample from Dahl, which tested positive for THC, an active component of marijuana. Dahl intends to get an alcohol evaluation, Dahl’s court-appointed defense attorney for all charges except the horse-theft case, Bernie Duffy, said Monday. Though the trailer Dahl was driving Nov. 13 had farm license plates, the criminal complaint alleges the vehicle is considered commercial because of the number of axles and its weight. Dahl does not have a commercial driver’s license. Dahl’s attorney for the grand theft and inhumane treatment of animals charges, Rapid City lawyer Patrick Duffy, declined to comment.

This is a sad time for anyone that rodeos,i was just at a rodeo and me and my kids went to grab a bite to eat,i found myself thinking should i lock the trailer so no one can take my mare....Funny how a few kids thinking they are just being boys can hurt one girl and her horse so bad and scar the hole rodeo world!! good luck and best wishes...

Beverly M said on 8/8/2009:
I am anxiously awaiting justice to be served in this case. The authorities need to step it up and serve the people of the community who pay their salaries. This was an unthinkable act of cowardess and the person/persons responsible should be publically chastised as well as serving a significant amount of time in jail thinking about what they did. Sorry for Wendy and so terribly sorry for Dually.

Dewey & Kelli in Riverton, WY said on 8/8/2009:
We talk about you and Dually everyday. This is a terrible thing to have happen and our prayers go out to you. Our best wishes to you both, first, for a great recovery for Dually and second, for justice to be served to the appropriate parties involved.

kim winstead said on 8/7/2009:
I am so sorry for what has happened to Dually and for the sorrow this horrible, senseless act has caused you and your beautiful horse. He will learn to trust and he knows you love him. They "always" know who loves them. Be strong for him now. He needs you. God Bless Dually and you in this difficult time. I will put you both in my prayers. As for the people who did this, God knows who you are and justice will be done, if not today, tomorrow, for eternity.

Linda said on 8/7/2009:
I hope that the people that stole your horse and hurt him will be arrested. I am from Ft. Pierre and my sister and I have four horses. It breaks my heart that someone would do that to an animal and if they get away with it what will they do next.

Why said on 8/6/2009:
Why are you not speaking out, why would you not talk to KELO Land News. Why are we being kept in the dark about the true progress on Dually. All we want is to know what is going on and the people who did this arrested. We would trust what Let the vet give a detailed statment about the injuries and recovery. Something - the new is giving us nothing but old news.

Wendy, My heart goes out to you and Dually. Thanks for setting up a sight to let the many that care know how you are doing. I am keeping you both in my prayers and hoping for justice for Dually. Though I doubt any punishment handed out could be harsh enough in the mind of the public and your fans.

Char Price said on 7/31/2009:
That is the other thing I forgot to mention. I will pray for the psychological consequences that were inflicted on your horse. He must have a very big heart. What a sweetheart. I hope that he learns that he can trust once again. People are traumatized and we are able to talk about it. Poor Dually is not able to, may he heal that aspect of his injuries as well. Char

Char Price said on 7/31/2009:
Those are beautiful pictures of you and your horse Dually. I think of you two daily. My heart just hurts for your horse. His resilience has given me courage in this life. What a wonderful animal. And, I believe God created him for us to care for and to look out for because he now needs our help. Our family is praying for him, we are buying a large amount of t shirts to sell to donate the proceeds to you. We will be at Rodeo Bible Camp in Kadoka, SD mon-thurs BB riding school. And we will see that you are both in the prayers of all in attendance. The healing may increase with the amount of prayer, I truly hope. You don't know me, but I have kept up on you and your horse. I have written a lot of letters for Dually. When you don't think you can go on any further, think of me. I will pray for you, that you will gain the strength to see this whole thing through. Love & Prayers, Char (my family-David Stangle-my husband, our three daughters twins-Alyssa & Michaela Bryan age 23 and Alaina Stangle age 12) We have a number of horses ourselves-34 geldings & stud colts. So you know we love horses. Take care of yourself, many people are thinking of you. my #605-685-3003

Wendy and Dually, I hsve been thinking and praying for both of you, I hope his wounds as well as his heart heals. Horses don't forget so easily. I too am very disappointed with the local authorities. What is taking so long. Because of this incident, I will be much more cautious. Best of luck to you and Dually. From ND.

My heart breaks for Wendy and her wonderful horse Dually. I wish no horse had to suffer under the hands of these heartless SOB/s. Please know we care.

Cheri Hopkins said on 7/30/2009:
I just heard about this through a mutual and dear friend. I pray for you and especially for Dually. God does take care of things like this, "they" will pay one way or the other, even if it does not come now in the way we would all like, it will come! Wish I could exact the punishment that I feel would be warranted. A sad world indeed. Give Dually some extra hugs from my Doggies. Animals love unconditionally and are the most innocent among us! I will pray for Dually.

http://legis.state.sd.us/statutes/DisplayStatute.aspx?Type=Statute&Statute=22-30A-17 This is the South Dakota state law that deals with theft of livestock. This is a class 4 felony. Class 4 felonies are punishable by 10 years in prison and $20,000 fine. They can also impose an order to pay restitution. If this was any other case or just a john doe that was accused, in my opinion, there would have been arrests done already.

Anita said on 7/28/2009:
You and Dually are in my prayers. I hope the persons who did this to him are punished severely. It is hard to believe your states attorney doesn't know if a crime was even committed.

Beth Braa said on 7/28/2009:
I can't express the anger I feel towards the individuals that did this to you and your beloved Dually. I would personally like to see those individuals treated and harmed as they did-saying goes "they should GET what they GAVE!" Next best thing is that they get punished to the extent the law should allow. But that doesn't help all you and your beloved "friend" have to endure. Know my prayers go out to you.

Nicki Daub said on 7/28/2009:
Wendy - you and Dually have been in my prayers daily. From the comment Ms. Schumacher left re: his condition at the Vet's it sounds like he is starting to heal - God is answering everyone's prayers. I believe justice will be served, hopefully soon, if not, one day by a Higher Power. Continued updates on Dually's and your recovery are appreciated.

I saw Dually the other day at the clinic. He was being happily hand grazed. He was very sweet. He nickered and nickered to the horse I had waiting on the trailer. So much in fact that I gladly took Legacy off to be a grazing buddy. Isn't it amazing how resiliant our equine friends can be.
